Introduction

The website www.mintit.in (the “Website”) and the mobile application (“MINTIT APP”) collectively referred to as the "Platform", is operated by Simplus Wealth Managers Private Limited, having its registered office at Fl No 304 B, Kanyakapuram Appartment, Dabha, Waddhamna, Hingna, Nagpur-440023, Maharashtra, as a SEBI registered Non-Individual Investment Adviser having SEBI registration number INA000022987 and BSE Enlistment Number 2554, being a wholly owned subsidiary of MintBox Fintech Private Limited, having its registered office at Fl No 304 B, Kanyakapuram Appartment, Dabha, Waddhamna, Hingna, Nagpur-440023, Maharashtra, as an AMFI-registered mutual fund distributor, having AMFI registration number ARN-281018, (hereinafter collectively referred to as "Group," “MINTIT”, "We," "Us,” or "Our,” whose expression shall include its affiliates, subsidiaries, successors and assigns). We respect your privacy and are committed to protecting it in accordance with this policy. 

“You” and “your” shall mean anyone who visits (visitors), accesses, or uses (registered users) the Platform or obtains services from us through the Platform. 

You are hereby advised to carefully review this privacy policy prior to using or registering on the Platform or accessing/availing of the services provided therein, as this privacy policy outlines the types of information, we may collect from you or that you may provide to us when you visit the Platform, as well as our practices for collecting, using, maintaining, protecting and disclosing that information. 

The terms as may be used in this document would be in accordance with the Information Technology Act 2000 as amended till date, the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, the “SIP Rules,” and such other rules/regulations and circulars as may be applicable. 

This policy applies to the information we collect: 

  • On the Platform. 
  • In email, text, and other electronic messages between you and the Platform. 
  • When you interact with our advertising and applications on third-party platforms and services, if those applications or advertising include links to the Platform. 
  • Through any other sources. 

Please read this policy carefully to understand our policies and practices regarding your information and our treatment thereof. Should you disagree with our policies and practices, you must refrain from using our Platform. By accessing or using this Platform, you consent to the collection, use and disclosure of your information in accordance with this privacy policy. This policy is subject to modifications from time to time. Your continued use of the Platform, following any amendments constitutes your acceptance of such changes; therefore, please periodically review this policy for updates. This Privacy Policy and the Terms of Use shall form an integral part of any and all agreements executed between MINTIT and the customer.

1.Information We Collect About You and How We Collect It

We may collect several types of information from and about our visitors and registered users of the Platform, including information: 

    a) Sensitive Personal Data / Information: Sensitive Personal Data or Information of a person means such personal information which consists of                 information relating to:

  1.  passwords; 
  2. financial information such as bank account, credit card, debit card or other payment instrument details;
  3. biometric Information; 
  4. any detail relating to the above clauses as provided to us for providing service;
  5. any of the information received under the above clauses by the body corporate for processing, stored or processing under a lawful contract or otherwise 

provided that any information that is freely available or accessible in the public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules. 

b) Personal Information:

Personal information collected by us from you may include (but is not limited to) your personal and demographic information, including identification/correspondence details including your name, user ID, photos/images, age, residential address, mobile number, email address, date of birth, Permanent Account Number (PAN), Aadhar Card Number, and nominee details. 

The said information is also being collected to be compliant with the Know Your Client (KYC) norms under the Prevention of Money Laundering Act, 2002 (PMLA), the rules issued thereunder, and guidelines and circular on anti-money laundering issued by SEBI and SEBI (Mutual Funds) Regulations, 1996, and the SEBI (Investment Advisers) Regulations, 2013, each as amended till date, in respect of investment advisory services availed through the Platform. 

c) Information You Provide to Us

The information we collect on or through our Platform may include: 

  • Information that you provide by filling out forms on our Platform. This includes information provided at the time of visiting and/or registering to use our Platform, subscribing to our service, or requesting further services. 
  • Records and copies of your correspondence, including email addresses, if you contact us. 
  • Your search queries on the Platform. 

Any other type of information that you provide us. 

d) Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including: 

  • Details of your visits to our Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Platform. 
  • Information about your computer and internet connection, including your IP address, operating system, and browser type. 

We also may use these technologies to collect information about your online activities over time and across third-party platforms or other online services for behavioural tracking. 

The information we collect automatically is only statistical data and does not include personal information. We may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Platform and deliver a better and more personalised service, including by enabling us to:

  • Store information about your preferences, allowing us to customise our Platform according to your individual interests. 
  • Speed up your searches. 
  • Recognise you when you return to our Platform. 

The technologies we use for this automatic data collection may include: 

  • Cookies (or browser cookies):A cookie is a small file placed on your computer's hard drive. You can refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Platform. Unless you have adjusted your browser settings to refuse cookies, our system will issue cookies when you direct your browser to our Platform. 
  • Web Beacons: Pages of our Platform, and our emails, may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs). These allow the company to, for example, count users who have visited those pages or opened an email and to compile other related Platform statistics. 
  • Flash Cookies: Certain features of our Platform may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation on our Platform. Flash cookies are not managed by the same browser settings as browser cookies.

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or that you provide to us. 

f)Grievance relatedinformation: Information on any complaints or queries raised by you to our support or grievance teams may be recorded in order to provide relevance solutions or responses to said queries. 

 

2) How We Use Your Information 

  • We process the information provided by you to perform our contractual services, including account opening, verification, KYC, transaction authorisations, and to comply with our terms of use. 
  • We use your personal information to communicate with you, whether directly in response to your queries or through newsletters or other communications. 
  • We use the PI to troubleshoot and improve the quality of our digital initiatives, to maintain our contacts database, to manage online accounts, including technical, administrative and security issues, and to understand how people use our services, including internal administration and data analytics in particular, with regard to the success of our digital and other initiatives. 
  • We may also use the information to conduct market research and analysis, provide personalised information and personalised content based on your activities and interaction with our Platform. 
  • We may process your data for undertaking financial/ regulatory reporting, complying with our legal obligations with public and governmental authorities, courts, regulators and other authorities to the extent applicable under law, and for protecting our rights under Data Protection laws. 

 

3) Disclosure to third parties 

 
In the course of provision of the services by MINTIT, MINTIT may disclose personal data collected from its customers to certain third parties, for limited and specific purpose, including but not limited to: 

  • entities providing various customer services such as IT services; 
  • entities providing marketing or advertising services; 
  • entities who are payment processors who may process the customers payment for MINTIT; 
  • entities providing data analytics and research services; 
  • entities providing system administration and hosting for the Platform; 
  • entities engaged by MINTIT to undertake KYC verification of its customers; 
  • entities or platforms or services engaged by MINTIT who are engaged in managing storage and retrieval of data; 
  • governmental, judicial and quasi-judicial authorities, to the extent required under applicable law, or any order or decree; 
  • professional advisors including lawyers, auditors, advisors etc. who are bound by confidentiality obligations; and 
  • entities which form part of the Group.  

 

4) Other Web Connections: Hypertext Links 

Our Platform also offers links to other sites, including advertisements on the Platform that are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies or other tracking technologies to collect information about you when you use our Platform. The information they collect may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different platforms and other online services. They may use this information to provide you with behavioural advertising or other targeted content for which we are not responsible either for their standards of public order and decency or for their personal data protection policy or for the use that could be made of such data. 

When you access another website through a hyperlink, you are accepting that this access is at your own risk. Consequently, we disclaim any direct or indirect loss suffered by you that may result from your access to another site connected by a hypertext link. Your use of such external links would be governed by the terms of use and the privacy policy of such external websites. 

 

5) Breach of Internet Security 

We prioritise the security of your data and employ stringent measures to safeguard it against unauthorised access, alteration, disclosure, or destruction. Our commitment to protecting your information is fundamental to our operations. However, it's essential to recognise that while we employ robust security measures, no system can guarantee absolute immunity from breaches or unauthorised access. 

By utilising our Platform, you acknowledge and accept the inherent risks associated with the transmission and storage of data over the internet. Despite our diligent efforts to fortify our security infrastructure, we cannot eliminate all potential vulnerabilities. 

You agree not to hold us liable for any unauthorised access to your personal data. While we strive to maintain the highest standards of data security, we cannot ensure or warrant that breaches will never occur. Therefore, you expressly understand and agree that your use of our Platform is at your own risk. 

Your use of our Platform signifies your understanding and acceptance of these terms regarding breaches of internet security. If you do not agree with any part of this policy, please refrain from using our Platform. 

 

6) Data Retention, Storage and Transfer 

We will not sell your personal information. We will not share your personal information with anyone for their independent use. 

We retain your personal information only as long as needed to provide our services or until you request its deletion. However, some personal information may be retained to support our legitimate business interests, including fraud detection, prevention, and enhancing safety. 

We may store and use your personal information to the extent necessary to comply with our legal obligations. For example, we may keep some of your information for tax, legal reporting and auditing obligations. Additionally, some copies of your information (e.g., log records) may remain in our database but are disassociated from personal identifiers. Because of the way we maintain certain services after you delete your information, residual copies may take time before they are deleted from our active servers and may remain in our backup systems. 

We may transfer your personal information to our partner companies or third parties to process your information as part of our customer services. 

 

7) Data Security 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorised access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers located in India behind firewalls. 

The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, the transmission of information via the internet is not completely secure. However, despite our utmost efforts to protect your personal information, we cannot warrant the security of any data you transmit to us through our Platform. By accepting this privacy policy, you accept that such transmission of your personal information is done at your own risk. Note that we are not liable for any third-party breaches to the security of your information. Lastly, you are requested to help us protect your data privacy by maintaining the secrecy of the username and password you use for any of our services. If you think that the security of your account has been compromised, change your password and contact us immediately for further assistance.

11) Governing Law & Jurisdiction 

This policy will be governed by and construed in accordance with the laws of India and subjected to the exclusive jurisdiction of the Courts of Nagpur.
